Residence permit for the purpose of family reunification

Hungary's new 2024 immigration law

In 2024, the new immigration law will tighten many aspects of the conditions for entry and residence of third-country nationals in Hungary. These changes have not spared the requirements for family reunification.

Based on the amended immigration law of 2024, we provide assistance to third-country nationals who already have residence permits (certain types), permanent residence permits or Hungarian citizens who wish to reunite with their family in Hungary.

We will help you to understand the process of relocating and to go through all the steps and prepare the necessary documents. 

Residence permit

for the purpose of family reunification

In general, residence permit for the purpose of family reunification may be granted to a third-country national (stateless person or non-EEA national) who is a family member of a person in possession of:

  • a residence permit,

  • an immigration permit, settlement permit, interim permanent residence permit, national permanent residence permit, EC permanent residence permit,

  • an interim residence card, a national residence card or an EU residence card,

  • a residence card, a permanent residence card for EEA nationals, a permanent residence card for third-country national family members,

  • a Hungarian citizen,

  

With the tightening up of the legislation, family members of third-country nationals residing or intending to reside in Hungary with the following residence permit will not be granted a residence permit for the purpose of family reunification:

  • guest self-employment (if does not hold a permit for at least a year),

  • seasonal employment,

  • investment,

  • employment,

  • guest workers,

  • White Card,

  • studies, training,

  • traineeship,

  • voluntary service.

 

As proof of the purpose of residence may serve birth certificate, marriage certificate, adoption document or any other credible evidence (DNA analysis).

The validity period of the permit shall be determined depending on the sponsor’s residence:

  • the general validity period is a maximum of 3 years, which on occasion may be extended by a maximum of 3 years,

  • in case of EU Blue Card or a Corporate Card, the validity period is a maximum of 4 years, which on occasion may be extended by a maximum of 4 years,

  • in case of Hungarian citizen or EC permanent residence permit or an EU residence card holder, the validity period is a maximum of 5 years, which on occasion may be extended by a maximum of 5 years,

  • in case of residence permit for guest investors, the validity period is a maximum of 10 years, which on occasion may be extended by a maximum of 10 years.
